Tred Terms & Conditions

1.      Agreement to Tred’s Terms and Conditions (T&Cs)

  • These T&Cs constitute a legally binding agreement between you (you), and Tred Earth Limited, doing business asTred (weus), concerning your access to and use of the Tred (www.tred.earth) website and our mobile application (the App).
  • Tred provides an online/mobile platform that offers services (Services) in the form of a Tred Debit Card and ability to link cards via Open Banking to enable customers to:
    • track the environmental impact of their purchases;
    • offset the carbon impact of their purchases by buying credits in a choice of carbon offsetting/removal projects;
    • reduce their overall carbon impact by being presented with low/zero carbon equivalents to standard products, utilities and services; and
    • contribute to tree planting every time they spend on the Tred Debit Card.
  • You agree that by accessing the App and/or Services, you have read, understood, and agree to be bound by all of these T&Cs.
  • If you do not agree with all of these T&Cs, then you are prohibited from using the App and Services and you must discontinue use immediately.
  • We may make changes to these T&Cs at any time, which will be indicated by an updated “Revised” date and the updated version will be effective as soon as it is accessible. You are responsible for reviewing these T&Cs to stay informed of updates. Your continued use of the App represents that you have accepted such changes.
  • We may update or change the App from time to time to reflect changes to our products, our customers’ needs and/or our business priorities.
  • Our App is directed to people residing in the United Kingdom. The information provided on the App is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country.
  • The App is intended for customers who are at least 18 years old. If you are under the age of 18, you are not permitted to register for the App or use the Services.

2.      Our Services

  • App membership: Membership of Tred is free and gives you access to apply for the Tred Debit Card, an ability to link to open banking connections, details of the carbon impact of your transactions, access to view/connect/receive discount from a selection of accredited companies and services with low/zero carbon footprint/ and other improved environmental/social credentials, and access to dynamic carbon offsetting bundles. Use of the Tred Debit Card will also mean trees are planted as you spend.
    • If you wish to close your Tred account at any time, you must contact us at support@tred.earth and we will cancel any subscriptions and suspend your related Tred Debit Card and any open banking connections. If your account is closed, you will not be able to use App functionality, although you will be able to manually request Tred Debit Card transaction history and we will arrange for any outstanding credit balance on your Tred Card will be transferred back to you.
    • You are only allowed to open one Tred account, for yourself. If we know or suspect you have more than one account, or you are opening an account for use of someone other than yourself, we may immediately suspend all accounts in your name and any related Tred Debit Cards.
    • Your Tred account is linked to your provided device (phone), provided email and provided phone number. You can change the phone number and e-mail via the Profile section of the Tred app after biometric or passcode authentication. If you lose your phone, you can regain access to your Tred account by verifying access to the provided email and phone number. If you lose access to your phone and either your provided email or provided phone number, you will need to contact us at support@tred.earth to verify your identity and regain access to your account.
  • Tred Debit Card: The Tred Debit Card is issued and processed by Nium Fintech Limited (Nium) who are an authorised Electronic Money Institution regulated by the Financial Conduct Authority (firm reference number 901024).  Tred is authorised by the FCA (firm reference number 945438) to act as a tied agent of Nium.

    • Cards are issued by Nium Fintech Limited (Nium) pursuant to license by Mastercard® International Inc. Mastercard is a registered trademark, and the circles design is a trademark of Mastercard International Incorporated.
    • Prior to submitting your card application to Nium, Tred will confirm that all applicants are UK residents, are over the age of 18 and conduct identity and anti-money laundering checks on applicants (this is not a credit check). You must answer all questions truthfully and only provide your own identity documents and face scan for verification.
    • Any applicants who do not pass our application criteria, or who do not pass our anti-money laundering control measures will have their Tred Debit Card application cancelled.
    • Successful applicants will have their details passed to Nium for Tred Debit Card issuing and processing.
    • The Tred Debit Card issuer and processor, Nium, automatically restrict certain types of transactions which include betting, jewellery and watches, automated fuel dispensers, debt repayments and adult content/escort services.     • Additional anti-fraud measures applied to the Tred Debit Card include the following card limits:
    • Maximum monthly spend on card: £4500
    • Maximum individual ATM withdrawal: £300
    • Maximum daily ATM withdrawal: £500
    • Customers are not able to currently make bank transfers from their Tred Debit Card wallet. If in the future we change this we will notify you.
    • Contactless limit for the Tred Debit Card is £100. For consecutive transactions you will be required to use chip and PIN when you hit a cumulative maximum spend of £300.
    • Tred Debit Card fees are:
    • ATM fee (UK): No fee for the first 5 withdrawals per calendar month, £1.50 for each ATM withdrawal after that in the same calendar month
    • ATM fee (International) £1.99 per withdrawal
    • Foreign Exchange fee: 0.5% on each transaction (you can view live exchange rate on the Tred website here – https://tred.earth/tred-exchange-rates/)
      • If a card is lost or stolen, Tred reserves the right to charge you £5.99 to issue a replacement to cover the cost to procure, package, post and offset the cost of your card.

  • Tred and Nium will continue to conduct anti-fraud checks on accounts while they are active, and Tred may ask Nium to suspend or cancel any debit cards and accounts to investigate any suspicions or issues.
  • When you spend on the Tred Debit Card, Tred will use part of the revenue earned from the card interchange fee to plant trees with our chosen partner. This chosen partner will be an accredited ‘1% for the planet’
  • Offsetting subscription: By identifying the carbon impact of a customer’s monthly purchases, Tred is able to offer customers the option of buying carbon offsetting/removal bundles. This is an opt-in service with limits controlled by the customer and can be cancelled at any time within the Tred app.
    • The Tred App displays available offsetting ‘bundles’ facilitated by our partner Lune, which customers are able to select in order to offset their calculated carbon footprint each month.
    • A Customer is able to select their chosen offsetting bundle, choose to cap the maximum amount they wish to pay for offsetting per month, or select whether they wish to multiply the amount they offset. These selections can be changed at any time in the Tred App.
    • If a customer chooses to offset, Tred will calculate their carbon footprint based on Tred Debit Card transactions, plus any transactions made on accounts the customer has linked to their Tred account via open banking, at the end of each calendar month.
    • Tred will offer customers the chance to exclude particular transactions from their carbon calculation if desired e.g., if you have already offset the transaction emissions by another means
    • Tred will then calculate the amount that the offset will cost based on the bundle the customer has selected, taking into consideration any cap/multiply amounts. Tred takes a small fee from the purchase of carbon offsetting bundles, and this fee is included in the calculation made.
    • On the fifth day of the following month Tred will take the offsetting payment from the customer’s Tred Debit Card. If there are insufficient funds on the Debit Card, the customer will not be charged, and their carbon footprint will not be offset.
    • When a customer makes an offsetting payment, Tred will send payment to our partner Lune who will fulfil the Order by either:
    • using Credits that Lune already holds in the projects contained in the selected bundle; or
    • purchasing the Credits directly from the relevant Partner.
    • If Lune does not already hold Credits in any Projects that form part of the selected bundle and Lune is unable to purchase any Credits in the bundle for which Tred has placed an Order, Tred will determine the most similar bundle to the Customer selection and purchase Credits at their discretion to the same value. Tred will alert the customer if this happens.
    • Once carbon credit purchases have been carried out, the purchased credits will be retired (meaning they cannot be purchased again by anyone else) and Lune will issue Tred with a certificate to confirm the retirement of the credits.
    • Tred will use reasonable endeavours to ensure the accuracy of the prices of offsetting bundles is displayed. However, it is always possible that some prices may be incorrect, as a result of a change within the month or due to error.
    • A customer can opt-out of offsetting at any time until the day before the payment is taken. If they do, no offsetting payment will be taken, and no purchase will be made on behalf of the customer for that month.
    • If a customer has not cancelled before the payment is taken (by the fourth of the month) and payment is taken, the offsetting order may not be cancelled or refunded.

  • Marketplace: The Tred Marketplace displays a number of vendors who may be able to help customers reduce their carbon footprint and/or shop more sustainably.
    • Although Tred takes reasonable efforts to verify the claims of vendors in our marketplace, the information is provided on an ‘as is’ basis and Tred make no warranties to the accuracy of vendor claims.
    • In addition, Tred cannot guarantee the accuracy, likely results or reliability of the use of services or goods within our app or website.
    • We will make every effort to ensure that offers, discounts and links are available and correct however, as these may change over time, we do not guarantee their availability and are not liable for any losses of discounts to our customers.
    • In some instances, Tred may receive a commission from a vendor when a customer clicks on a link or utilises a code from the marketplace.
  • Open Banking: Tred App customers can link alternative bank/payment accounts to their Tred App in order to view transactions and offset carbon emission of their purchases on those cards.
    • Tred uses an Account Information Service Provider (AISP) to access and display a customer’s alternative bank account transaction information only when you give your bank explicit consent to allow access to that information.
    • This consent is managed in the Tred app via connections to your bank/payment institution and these connections can be unlinked by you at any time.
    • You will be asked every 90 days to re-consent to this open banking connection to continue to see additional bank transactions in the Tred app from your linked accounts. If you do not re-consent, 90 days after your last consent, the connection will be stopped, and you will no longer see or be able to offset those transactions (unless you re-authorise).
    • This ‘Open Banking’ connection is a regulated service, provided by Tred as an agent of Plaid Financial Ltd., an authorised payment institution regulated by the Financial Conduct Authority under the Payment Services Regulations 2017 (Firm Registration Number: 804718) for the provision of payment services, including account information services. Tred is an authorised agent of Plaid with the FCA (firm reference number 945438).

  • Customer Service:
    • We provide a knowledge hub of frequent queries to allow you to resolve most issues and questions on our website https://tred.zendesk.com/hc/en-us
    • If you cannot find an answer or want to raise an issue, complaint or give us feedback you can contact support@tred.earth where our support team are available 9-5, Monday-Friday
    • If you believe your card is lost, stolen or misappropriated or you suspect any kind of fraud you must IMMEDIATELY freeze your card in the Tred App then contact us with your concerns (See Nium Card T&Cs for your rights and obligations regarding disputed/unauthorised transactions – https://tred.earth/nium-terms/)

3.      Our content

  • Unless otherwise indicated, the App and Services including source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the App (Our Content) are owned or licensed to us and are protected by copyright and trademark laws.
  • Except as expressly provided in these T&Cs, no part of the App, Services or Our Content may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.
  • Provided that you are eligible to use the App, you are granted a limited licence to access and use the App and Our Content and to download or print a copy of any portion of the Content to which you have properly gained access solely for your personal, non-commercial use.
  • You shall not (a) try to gain unauthorised access to the App or any networks, servers or computer systems connected to the App; and/or (b) make for any purpose including error correction, any modifications, adaptions, additions or enhancements to the App or Our Content, including the modification of the paper or digital copies you may have downloaded.
  • We shall (a) prepare the App and Our Content with reasonable skill and care; and (b) use industry standard virus detection software to try to block the uploading of content to the App that contains viruses.
  • The content on the App is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from taking, any action on the basis of the content on the App.
  • Although we make reasonable efforts to update the information on our App, we make no representations, warranties or guarantees, whether express or implied, that Our Content on the App is accurate, complete or up to date.

 

4.      Acceptable Use

  • You may not access or use the App for any purpose other than that for which we make the Tred App and our services available. The App may not be used in connection with any commercial endeavours except those that are specifically endorsed or approved by us.
  • As a user of the App, you agree not to:
    • Systematically retrieve data or other content from the App to compile database or directory
    • Make any unauthorised use of the App, including creating customer accounts under false pretences
    • Circumvent, disable, or otherwise interfere with security-related features of the App, including features that prevent or restrict the use or copying of any content or enforce limitations on its use
    • Engage in unauthorised framing of or linking to the App
    • Trick, defraud, or mislead us and other customers, especially in any attempt to learn sensitive account information
    • Make improper use of our support services, or submit false reports of abuse or misconduct
    • Engage in any automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools
    • Interfere with, disrupt, or create an undue burden on the App or the networks and services connected to the App
    • Sell or otherwise transfer your profile
    • Use any information obtained from the App in order to harass, abuse, or harm another person
    • Attempt to impersonate another user or person, or use the profile of another user
    • Decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the App
    • Attempt to access any portions of the App that you are restricted from accessing
    • Harass, annoy, intimidate, or threaten any of our employees, agents, or other users
    • Delete the copyright or other proprietary rights notice from any of the content
    • Copy or adapt the App’s software, including but not limited to Flash, PHP, HTML, JavaScript, or other code
    • Upload or transmit (or attempt to upload or to transmit) viruses, Trojan horses, or other material that interferes with any party’s uninterrupted use and enjoyment of the App, or any material that acts as a passive or active information collection or transmission mechanism
    • Use, launch, or engage in any automated use of the system, such as using scripts to send comments or messages, robots, scrapers, offline readers, or similar data gathering and extraction tools
    • Disparage, tarnish, or otherwise harm, in our opinion, us and/or the App
    • Use the App in a manner inconsistent with any applicable laws or regulations
    • Falsely imply a relationship with us or another company with whom you do not have a relationship
    • Use the app in any way which facilitates fraud, money laundering or otherwise circumvent international sanctions
    • Use the app in any way which breaks the law

5.      App Management

  • We reserve the right at our sole discretion, to (1) monitor the App for breaches of these T&Cs; (2) take appropriate legal action against anyone in breach of applicable laws or these T&Cs; (3) remove from the App or otherwise disable all files and content that are excessive in size or are in any way a burden to our systems; and (4) otherwise manage the App in a manner designed to protect our rights and property and to facilitate the proper functioning of the App and Services.
  • While Tred takes all practical steps to ensure the App is secure from viruses and bugs, we cannot guarantee this in every instance.
  • You are responsible for configuring your information technology, computer programs and platform to access the App and you should use your own virus protection software.

 

6.      Modifications to and availability of the App

  • We reserve the right to change, modify, or remove the contents of the App at any time or for any reason at our sole discretion without notice. We also reserve the right to modify or discontinue all or part of the Services without notice at any time.
  • While Tred takes all practical steps to ensure constant availability, we cannot guarantee the App and Services will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the App, resulting in interruptions, delays, or errors. You agree that we have no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use the App or Services during any downtime or discontinuance of the App or Services. We are not obliged to maintain and support the App or Services or to supply any corrections, updates, or releases.
  • There may be information on the App that contains typographical errors, inaccuracies, or omissions that may relate to the Services, including descriptions, pricing, availability, and various other information. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information at any time, without prior notice.

 

7.      Disclaimer/Limitation of Liability

  • The App and Services are provided on an as-is and as-available basis. You agree that your use of the App and/or Services will be at your sole risk except as expressly set out in these T&Cs. All warranties, terms, conditions and undertakings, express or implied (including by statute, custom or usage, a course of dealing, or common law) in connection with the App and Services and your use thereof including, without limitation, the implied warranties of satisfactory quality, fitness for a particular purpose and non-infringement are excluded to the fullest extent permitted by applicable law.
  • We make no warranties or representations about the accuracy or completeness of the App’s content and are not liable for any (1) errors or omissions in content; (2) any unauthorized access to or use of our servers and/or any and all personal information and/or financial information stored on our server; (3) any interruption or cessation of transmission to or from the App or services; and/or (4) any bugs, viruses, trojan horses, or the like which may be transmitted to or through the App by any third party. We will not be responsible for any delay or failure to comply with our obligations under these T&Cs if such delay or failure is caused by an event beyond our reasonable control.
  • Our responsibility for loss or damage suffered by you:
    • We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.
    • If we fail to comply with these T&Cs, we will be responsible for loss or damage you suffer that is a foreseeable result of our breach of these T&Cs, but we would not be responsible for any loss or damage that were not foreseeable at the time you started using the App/Services.
    • Notwithstanding anything to the contrary contained in the Disclaimer/Limitation of Liability section, our liability to you for any cause whatsoever and regardless of the form of the action, will at all times be limited to a total aggregate amount equal to the greater of (a) the sum of £300 or (b) the amount paid, if any, by you to us for the Services/App during the six (6) month period prior to any cause of action arising.
    • Please note that we only provide our App for domestic and private use. You agree not to use our App for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
    • If defective digital content that we have supplied, damages a device or digital content belonging to you and this is caused by our failure to use reasonable care and skill, we will either repair the damage or pay you compensation. However, we will not be liable for damage that you could have avoided by following our advice to apply an update offered to you free of charge or for damage that was caused by you failing to correctly follow installation instructions or to have in place the minimum system requirements advised by us.
    • You have legal rights in relation to goods that are faulty or not as described. Advice about your legal rights is available from your local Citizens’ Advice Bureau or Trading Standards office. Nothing in these T&Cs will affect these legal rights.

8.       Term and Termination

  • These T&Cs shall remain in full force and effect while you use the App or Services or are otherwise a user of the App, as applicable. You may terminate your use or participation at any time, for any reason, by following the instructions for terminating customer accounts in your account settings, if available, or by contacting us at support@tred.earth.
  • When you download our App, we grant you a revocable, non-exclusive, non-transferable, limited right to install on wireless electronic devices owned or controlled by you, and to access and use the app on such devices strictly in accordance with the T&Cs
  • Without limiting any other provision of these T&Cs, we reserve the right to, in our sole discretion and without notice or liability, deny access to and use of the App and the Services (including blocking certain IP addresses), to any person for any reason including without limitation for breach of any representation, warranty or covenant contained in these T&Cs or of any applicable law or regulation.
  • If we determine, in our sole discretion, that your use of the App/Services is in breach of these T&Cs or of any applicable law or regulation, we may terminate your use or participation in the App and the Services or delete any content or information that you posted at any time, without warning, in our sole discretion.
  • If we terminate or suspend your account for any reason set out in this Section, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party, even if you may be acting on behalf of the third party. In addition to terminating or suspending your account, we reserve the right to take appropriate legal action, including without limitation pursuing civil, criminal, and injunctive redress.

9.      General 

  • Visiting the App/website, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically, via email and on the App, satisfy any legal requirement that such communication be in writing.
  • You hereby agree to the use of electronic signatures, contracts, orders and other records and to electronic delivery of notices, policies and records of transactions initiated or completed by us or via the App.You hereby waive any rights or requirements under any statutes, regulations, rules, ordinances or other laws in any jurisdiction which require an original signature or delivery or retention of non-electronic records, or to payments or the granting of credits by other than electronic means.
  • These T&Cs and any policies or operating rules posted by us on the App or in respect to the Services constitute the entire agreement and understanding between you and us.
  • Our failure to exercise or enforce any right or provision of these T&Cs shall not operate as a waiver of such right or provision.
  • We may assign any or all of our rights and obligations to others at any time.
  • We shall not be responsible or liable for any loss, damage, delay or failure to act caused by any cause beyond our reasonable control.
  • If any provision or part of a provision of these T&Cs is unlawful, void or unenforceable, that provision or part of the provision is deemed severable from these T&Cs and does not affect the validity and enforceability of any remaining provisions.
  • There is no joint venture, partnership, employment or agency relationship created between you and us as a result of these T&Cs or use of the App or Services.
  • Please note that these T&Cs, their subject matter and their formation, are governed by English law. You and we both agree that the courts of England and Wales will have exclusive jurisdiction expect that if you are a resident of Northern Ireland, you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.
  • Except as stated under the Mobile Application section, a person who is not a party to these T&Cs shall have no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of these T&Cs.
